Obama Using Executive Orders To Bypass Congress And Rule Of Law

President Barack Obama’s campaign slogan is springing to life in a surge of executive directives and agency rule-making that touch many of the affairs of government. They are shaping the cost and quality of health plans, the contents of the school cafeteria, the front lines of future combat, the price of coal. They are the leading edge of Obama’s ambition to take on climate change in ways that may be unachievable in legislation.
Altogether, it’s a kinetic switch from what could have been the watchword of the Obama administration in the closing, politically hypersensitive months of his first term: pause. Whatever the merits of any particular commandment from the president or his agencies, the perception of a government expanding its reach and hitting business with job-killing mandates was sure to set off fireworks before November.
Since Obama’s re-election, regulations giving force and detail to his health care law have gushed out by the hundreds of pages. To some extent this was inevitable: The law is far-reaching and its most consequential deadlines are fast approaching.
The rules are much more than fine print, however, and they would have thickened the storm over the health care overhaul if placed on the radar in last year’s presidential campaign. That, after all, was the season when some Republicans put the label “death panel” (one that some have dubbed “over-the-top”) on a board that could force cuts to service providers if Medicare spending ballooned.
The new health law rules provide leeway for insurers to charge smokers thousands of dollars more for coverage. They impose a $63 per-head fee on insurance plans — a charge that probably will be passed on to policyholders — to cushion the cost of covering people with medical problems. There’s a new fee for insurance companies for participating in markets that start signing customers in the fall.
In short, sticker shock
It’s clear from the varied inventory of previously bottled-up directives that Obama cares about more than “Obamacare.”
“I’m hearing we’re going to see a lot of things moving now,” Hilda Solis told employees in her last day as labor secretary. At the Labor Department, this could include regulations requiring that the nation’s 1.8 million in-home care workers receive minimum-wage and overtime pay.
After the terrorist attacks of Sept. 11, 2001, President George W. Bush approved a series of executive orders that created an office of homeland security, froze the assets in U.S. banks linked to al-Qaida and other terrorist groups, and authorized the military services to call reserve forces to active duty for as long as two years.
Bush’s most contentious move came in the form of a military order approving the use of the military tribunals to put accused terrorists on trial faster and in greater secrecy than a regular criminal court.
Obama also has wielded considerable power in secret, upsetting the more liberal wing of his own party. He has carried forward Bush’s key anti-terrorism policies and expanded the use of unmanned drone strikes against terrorist targets in Pakistan and Yemen.
When a promised immigration overhaul failed in legislation, Obama went part way there simply by ordering that immigrants brought illegally to the United States as children be exempted from deportation and granted work permits if they apply. Obama Given Power To Target American Citizens For Execution Without Charges

The most extremist power any political leader can assert is the power to target his own citizens for execution without any charges or due process, far from any battlefield. The Obama administration has not only asserted exactly that power in theory, but has exercised it in practice. In September 2011, it killed US citizen Anwar Awlaki in a drone strike in Yemen, along with US citizen Samir Khan, and then, in circumstances that are still unexplained, two weeks later killed Awlaki’s 16-year-old American son Abdulrahman with a separate drone strike in Yemen.

This new memo is entitled: “Lawfulness of a Lethal Operation Directed Against a US Citizen Who is a Senior Operational Leader of Al-Qa’ida or An Associated Force”. It claims its conclusion is “reached with recognition of the extraordinary seriousness of a lethal operation by the United States against a US citizen”. Yet it is every bit as chilling as the Bush OLC torture memos in how its clinical, legalistic tone completely sanitizes the radical and dangerous power it purports to authorize.
Since then, senior Obama officials including Attorney General Eric Holder and John Brennan, Obama’s top terrorism adviser and his current nominee to lead the CIA, have explicitly argued that the president is and should be vested with this power. Meanwhile, a Washington Post article from October reported that the administration is formally institutionalizing this president’s power to decide who dies under the Orwellian title “disposition matrix”.
When the New York Times back in April, 2010 first confirmed the existence of Obama’s hit list, it made clear just what an extremist power this is, noting: “It is extremely rare, if not unprecedented, for an American to be approved for targeted killing.” The NYT quoted a Bush intelligence official as saying “he did not know of any American who was approved for targeted killing under the former president”. When the existence of Obama’s hit list was first reported several months earlier by the Washington Post’s Dana Priest, she wrote that the “list includes three Americans”.
What has made these actions all the more radical is the absolute secrecy with which Obama has draped all of this. Not only is the entire process carried out solely within the Executive branch – with no checks or oversight of any kind – but there is zero transparency and zero accountability.
The president’s underlings compile their proposed lists of who should be executed, and the president – at a charming weekly event dubbed by White House aides as “Terror Tuesday” – then chooses from “baseball cards” and decrees in total secrecy who should die. The power of accuser, prosecutor, judge, jury, and executioner are all consolidated in this one man, and those powers are exercised in the dark.
In fact, The Most Transparent Administration Ever™ has been so fixated on secrecy that they have refused even to disclose the legal memoranda prepared by Obama lawyers setting forth their legal rationale for why the president has this power. During the Bush years, when Bush refused to disclose the memoranda from his Office of Legal Counsel (OLC) that legally authorized torture, rendition, warrantless eavesdropping and the like, leading Democratic lawyers such as Dawn Johnsen (Obama’s first choice to lead the OLC) vehemently denounced this practice as a grave threat, warning that “the Bush Administration’s excessive reliance on ‘secret law’ threatens the effective functioning of American democracy” and “the withholding from Congress and the public of legal interpretations by the [OLC] upsets the system of checks and balances between the executive and legislative branches of government.”
But when it comes to Obama’s assassination power, this is exactly what his administration has done. It has repeatedly refused to disclose the principal legal memoranda prepared by Obama OLC lawyers that justified his kill list. It is, right now, vigorously resisting lawsuits from the New York Times and the ACLU to obtain that OLC memorandum. In sum, Obama not only claims he has the power to order US citizens killed with no transparency, but that even the documents explaining the legal rationale for this power are to be concealed. From France 24: France’s Esther Duflo, a world renowned economist, has been nominated by US President Barack Obama to join a government body dedicated to advising the administration on global development policy.
Called the Global Development Council, the group was founded by Obama in 2010 to help shape US development efforts abroad.
While Duflo’s nomination will likely be viewed with a sense of pride in France, it comes as Obama’s leadership continues to be dogged by unflattering comparisons in the media to European-style socialism.
Just Friday, the cover of financial news magazine The Economist depicted Obama wearing a beret, red neckerchief and a striped mariner shirt, under a headline that read “America turns European”. The article criticised the country’s recent fiscal-cliff deal as “lousy”, saying its mismanagement bore striking similarities to the “mess in the euro zone”.
Duflo, who was raised in a “left-leaning Protestant” family, said she became aware of economic divides and social injustice at a very early age.
A rising star
“I was always conscientious of the gap between my existence and that of the world’s poor,” she told weekly French magazine l’Express in a January, 2011 article. “As a child, I was extremely troubled by the complete randomness of chance that I was born in Paris to an intellectual, middle class family, when I could have just as easily been born in Chad. It’s a question of luck. It inspired in me a sense of responsibility.”
While Duflo may feel that her privilege in life is the result of chance, President Obama’s intention to appoint her to his Global Development Council is not. Ever since completing her undergraduate studies at Paris’s prestigious Ecole Normale Supérieure in 1994, Duflo has led a distinguished career, collecting numerous academic honours and awards along the way.
One of the world’s 100 most influential people
It is by no means an exaggeration to call the now 40 year-old Duflo one of the world’s star economists. French daily Le Monde once awarded her its “Best French Young Economist Prize”, and in 2009, she was granted a MacArthur Fellowship (which has also been dubbed ‘the genius grant’). Duflo’s work also earned her the John Bates Clark medal in 2010, which is considered second only to the Nobel.
The following year, Time magazine named Duflo one of 100 most influential people in the world. The magazine applauded her for relentlessly “questioning conventional wisdom”.
“She has broken out of the ivory tower to do something economists rarely do: gather real data to see what really works in alleviating poverty,” Time wrote.
A closer look at poverty
Duflo’s research has largely focused on microeconomic issues in developing countries and looks at areas such as education, access to finance as well as health and policy evaluation. As co-founder and director of MIT’s Abdul Latif Jameel Poverty Action Lab, Duflo has singled herself out by championing the idea that it is impossible to successfully tackle the issue of poverty without a thorough understanding of the population at hand. In other words, the devil is in the detail.
While Duflo’s work has already helped contribute to changing the way governments and organisations deal with global poverty, her potential new role as a member of the Global Development Council will allow her to have a direct impact on how the US handles such issues. source – France 24

Warrantless wiretaps was one of the many, many things that Obama attacked George Bush over. But as president, Obama has renewed nearly every, single bill that Bush ever signed into law. Kinda funny that, eh?
From AP: WASHINGTON (AP) — President Barack Obama has signed into law a five-year extension of the U.S. government’s authority to monitor the overseas activity of suspected foreign spies and terrorists.
The warrantless intercept program would have expired at the end of 2012 without the president’s approval. The renewal bill won final passage in the Senate on Friday.
Known as the Foreign Intelligence Surveillance Act, the law allows the government to monitor overseas phone calls and emails without obtaining a court order for each intercept.
The law does not apply to Americans. When Americans are targeted for surveillance, the government must get a warrant from a special 11-judge court of U.S. district judges appointed by the Supreme Court. source – AP
United Nations To Begin Planning International Drone Surveillance

The U.N. wants to use drones, the French news agency Agence France-Presse reports. “The United Nations wants to use drones for the first time to monitor fighting in the eastern Democratic Republic of Congo, where Rwanda has been accused of aiding rebels,” says the report, quoting U.N. officials.

An unnamed diplomat says, “The UN has approached a number of countries, including the United States and France, about providing drones which could clearly play a valuable role monitoring the frontier. … Clearly there will be political considerations though.”
The international body “is considering a range of ways to strengthen the capabilities of MONUSCO to protect civilians from the threat of armed groups in the vast area of eastern DR Congo,” a U.N. spokesman says.
“Unarmed aerial vehicles, drones for monitoring the movements of armed groups, are one tool we are considering.”
The spokesman, Kieran Dwyer, insists the U.N.’s use of drones would be done carefully.
“Of course, we would do this carefully, in full cooperation with the government of the DR Congo, and trialing their most effective uses for information gathering to help implement our mandate to protect civilians,” says the spokesman.
“Ultimately, to introduce these, we would need the support of member states to equip the mission.”
An unnamed diplomat says, “The UN has approached a number of countries, including the United States and France, about providing drones which could clearly play a valuable role monitoring the frontier. … Clearly there will be political considerations though.”
It is not clear whether any of the countries have agreed to work with the U.N. on the budding drone program. (CNSNews.com) – The head of an international body that will monitor the U.S. elections next month protested to Secretary of State Hillary Clinton Wednesday after Texas’ attorney-general warned that any international observer who approaches a polling station in the state risks criminal prosecution.

While You Were Sleeping – If all the talk about a coming One World Government is just “crazy conspiracy talk”, then why is a European vote-monitoring board affiliated with the United Nations coming to America to monitor and oversee our voting process?
“The threat of criminal sanctions … is unacceptable,” said Janez Lenarcic, the Slovenian diplomat who heads the Office for Democratic Institutions and Human Rights (ODIHR), a part of the Organization for Security and Co-operation in Europe (OSCE).
“The United States, like all countries in the OSCE, has an obligation to invite ODIHR observers to observe its elections,” he said in a statement. It added that he “shared his concerns in a letter” to Clinton.
Lenarcic was responding to a letter sent by Texas Attorney General Greg Abbott to the ODIHR Tuesday informing it that “groups and individuals from outside the United States are not allowed to influence or interfere with the election process in Texas.”
“The OSCE’s representatives are not authorized by Texas law to enter a polling place,” Abbott wrote. ‘It may be a criminal offense for OSCE’s representatives to maintain a presence within 100 feet of a polling place’s entrance. Failure to comply with these requirements could subject the OSCE’s representatives to criminal prosecution for violating state law.”
Lenarcic’s letter to Clinton is the latest development in a simmering controversy over an OSCE/ODIHR mission that aims to assess the November 6 vote “for compliance with international obligations and standards for democratic elections.”
As reported earlier, the mission includes observers from several non-democratic countries that are members of the OSCE, including Azerbaijan, Belarus, Kazakhstan and Kyrgyzstan. More than a quarter – 12 of a total 44 observers – come from countries assessed by Freedom House as either “not free” or “partly free.”
The plans have triggered some protests on the campaign trail.
“Every American should be outraged by this news,” Rep. Connie Mack (R-Fla.), who is running for a seat in the U.S. Senate, declared on Monday.
International monitoring of elections is “usually reserved for third-world countries, banana republics and fledgling democracies,” he said. “The only ones who should ever oversee American elections are Americans.”
The speaker of the Alabama House of Representatives, Mike Hubbard,announced plans to introduce legislation that would bar non-U.S. citizens from observing elections in the state in future.
“If you can’t participate in an election in the United States, and if you can’t cast a vote in the United States, you really have no business serving as a poll watcher in an election being held in the United States,” he said. read the rest of the story on CNS NEWS

Here at NTEB, we have speculated at length on what type of dirty tricks Obama will use to retain his grasp on power in America. Some have suggested he will declare martial law and cancel the elections. Others have said he and George Soros will buy the vote. But whatever form it intimately takes. the following story on vote monitoring by the United Nations should send a cold, wet chill down your spine. At the very least, you should be outraged.

From The Hill: United Nations-affiliated election monitors from Europe and central Asia will be at polling places around the U.S. looking for voter suppression activities by conservative groups, a concern raised by civil rights groups during a meeting this week. The intervention has drawn criticism from a prominent conservative-leaning group combating election fraud.
The Organization for Security and Cooperation in Europe (OSCE), a United Nations partner on democratization and human rights projects, will deploy 44 observers around the county on Election Day to monitor an array of activities, including potential disputes at polling places.
Liberal-leaning civil rights groups met with representatives from the OSCE this week to raise their fears about what they say are systematic efforts to suppress minority voters likely to vote for President Obama.
The Leadership Conference on Civil and Human Rights, the NAACP and the ACLU, among other groups, warned this month in a letter to Daan Everts, a senior official with OSCE, of “a coordinated political effort to disenfranchise millions of Americans — particularly traditionally disenfranchised groups like minorities.”
The request for foreign monitoring of election sites drew a strong rebuke from Catherine Engelbrecht, founder and president of True the Vote, a conservative-leaning group seeking to crack down on election fraud.
“These activist groups sought assistance not from American sources, but from the United Nations,” she said in a statement to The Hill. “The United Nations has no jurisdiction over American elections.”
The observers, from countries such as Germany, France, Serbia, Belarus, Ukraine and Kazakhstan, will observe voting at polling places and other political activity.
“They [will] observe the overall election process, not just the ballot casting,” said Giovanna Maiola, spokeswoman for OSCE. “They are focusing on a number of areas on the state level, including the legal system, election administration, the campaign, the campaign financing [and] new voting technologies used in the different states.”
In a follow-up e-mail, Maiola noted that it is a limited election-observation mission. She said “the OSCE has regularly been invited to observe elections in the United States, in line with OSCE commitments.”
Access of international observers during voting is explicitly allowed in some states such as Missouri, South Dakota, North Dakota and New Mexico.
“State law does not generally provide for international observers,” Maiola said. “However, through our contacts at state and county level in certain states, we managed to secure invitations at local level and we have taken up the offer to observe. Where this is not possible, we will respect the state regulation on this matter and will not observe in precincts on Election Day.”
International observers will follow up on the concerns raised by civil rights groups
“We attended their meeting, we took note of the issued they raised and we asked our observers in the field to follow up on them,” said Maiola.
The OSCE has 56 participating states from Europe, Central Asia and North America, including the United States and Canada. It has assessed elections in the United States since 2002.
Voting is expected to be more contentious this November than in past years because of a running battle over election law pitting conservative groups and Republican state officials against the Obama administration and liberal allies.
The Obama campaign scored a victory this week when the Supreme Court declined to hear an appeal filed by Republican officials in Ohio seeking to limit the state’s early voting program.
Last month in Wisconsin, the state Supreme Court declined to immediately review lower-court rulings invalidating a voter-identification law signed by Republican Gov. Scott Walker. In Florida, judges stopped attempts to restrict voter-registration drives but allowed measures to reduce days of early voting and to remove non-citizens from voting rolls to stand.
Both sides expect wrangling over voter identification and eligibility to extend to polling places and are recruiting armies of volunteers for Election-Day showdowns.
True the Vote, a group with Tea Party origins, has an ambitious plan to deploy hundreds of thousands of volunteers at polling stations to monitor election fraud.
“We may surpass a million volunteers or fall short, it will be hard to know,” said Engelbrecht. “But we’re very excited about the level of enthusiasm, the number of volunteers, and the fact that we had a positive impact in bringing awareness to this important issue, of election integrity.”
Democratic allies will counter with their own forces. The AFL-CIO will dispatch 300 lawyers to monitor poll workers and third-party groups challenging voter registration.
The Advancement Project, a self-described multi-racial civil rights organization, will send more than 3,000 poll watchers to battleground states.
The Election Protection coalition, which includes Democratic allies such as the Sierra Club, Service Employees International Union and People for the American Way, plans to recruit 8,000 to 10,000 volunteers to cover 80 cities and counties.
“We hope that all groups that are putting people at a polling place, that they should follow the law and they should be there to make sure that responsible Americans who wish to participate in our democracy are able to free of intimidation,” said Eric Marshall, co-leader of Election Protection.
Civil rights groups have complained about what they say are subtle efforts of intimidation. They point to a billboard campaign in swing states such as Ohio warning voter fraud is a felony punishable by up to three and a half years in prison and a $10,000 fine.
Engelbrecht of True the Vote says intimidation is not her group’s motive.
“We are not in the business of picking winners or losers, but instead, to ensure that the process is iron-clad,” she said. “Properly trained a capable poll watchers or workers should offer no indication of their partisan or ideological leanings to voters at the polls.” source – The Hill
