Secret panel can put Americans on “kill list’
(Reuters) – American militants like Anwar al-Awlaki are placed on a kill or capture list by a secretive panel of senior government officials, which then informs the president of its decisions, according to officials.
Are YOU on the list? Are you sure?
There is no public record of the operations or decisions of the panel, which is a subset of the White House’s National Security Council, several current and former officials said. Neither is there any law establishing its existence or setting out the rules by which it is supposed to operate.
The panel was behind the decision to add Awlaki, a U.S.-born militant preacher with alleged al Qaeda connections, to the target list. He was killed by a CIA drone strike in Yemen late last month.
The role of the president in ordering or ratifying a decision to target a citizen is fuzzy. White House spokesman Tommy Vietor declined to discuss anything about the process.
Current and former officials said that to the best of their knowledge, Awlaki, who the White House said was a key figure in al Qaeda in the Arabian Peninsula, al Qaeda’s Yemen-based affiliate, had been the only American put on a government list targeting people for capture or death due to their alleged involvement with militants.
The White House is portraying the killing of Awlaki as a demonstration of President Barack Obama’s toughness toward militants who threaten the United States. But the process that led to Awlaki’s killing has drawn fierce criticism from both the political left and right.
In an ironic turn, Obama, who ran for president denouncing predecessor George W. Bush’s expansive use of executive power in his “war on terrorism,” is being attacked in some quarters for using similar tactics. They include secret legal justifications and undisclosed intelligence assessments.
Liberals criticized the drone attack on an American citizen as extra-judicial murder.
Conservatives criticized Obama for refusing to release a Justice Department legal opinion that reportedly justified killing Awlaki. They accuse Obama of hypocrisy, noting his administration insisted on publishing Bush-era administration legal memos justifying the use of interrogation techniques many equate with torture, but refused to make public its rationale for killing a citizen without due process.
Some details about how the administration went about targeting Awlaki emerged on Tuesday when the top Democrat on the House Intelligence Committee, Representative Dutch Ruppersberger, was asked by reporters about the killing.
The process involves “going through the National Security Council, then it eventually goes to the president, but the National Security Council does the investigation, they have lawyers, they review, they look at the situation, you have input from the military, and also, we make sure that we follow international law,” Ruppersberger said. source – Reuters

Outside the U.S. government, President Obama’s order to kill American citizen Anwar al-Awlaki without due process has proved controversial, with experts in law and war reaching different conclusions. Inside the Obama Administration, however, disagreement was apparently absent, or so say anonymous sources quoted by the Washington Post. “The Justice Department wrote a secret memorandum authorizing the lethal targeting of Anwar al-Aulaqi, the American-born radical cleric who was killed by a U.S. drone strike Friday, according to administration officials,” the newspaper reported. “The document was produced following a review of the legal issues raised by striking a U.S. citizen and involved senior lawyers from across the administration. There was no dissent about the legality of killing Aulaqi, the officials said.”
Isn’t that interesting? Months ago, the Obama Administration revealed that it would target al-Awlaki. It even managed to wriggle out of a lawsuit filed by his father to prevent the assassination. But the actual legal reasoning the Department of Justice used to authorize the strike? It’s secret. Classified. Information that the public isn’t permitted to read, mull over, or challenge.
Why? What justification can there be for President Obama and his lawyers to keep secret what they’re asserting is a matter of sound law? This isn’t a military secret. It isn’t an instance of protecting CIA field assets, or shielding a domestic vulnerability to terrorism from public view.
This is an analysis of the power that the Constitution and Congress’ post September 11 authorization of military force gives the executive branch. This is a president exploiting official secrecy so that he can claim legal justification for his actions without having to expose his specific reasoning to scrutiny. As the Post put it, “The administration officials refused to disclose the exact legal analysis used to authorize targeting Aulaqi, or how they considered any Fifth Amendment right to due process.”
Obama hasn’t just set a new precedent about killing Americans without due process. He has done so in a way that deliberately shields from public view the precise nature of the important precedent he has set. It’s time for the president who promised to create “a White House that’s more transparent and accountable than anything we’ve seen before” to release the DOJ memo. As David Shipler writes, “The legal questions are far from clearcut, and the country needs to have this difficult discussion.” And then there’s the fact that “a good many Obama supporters thought that secret legal opinions by the Justice Department — rationalizing torture and domestic military arrests, for example — had gone out the door along with the Bush administration,” he adds. “But now comes a momentous change in policy with serious implications for the Constitution’s restraint on executive power, and Obama refuses to allow his lawyers’ arguments to be laid out on the table for the American public to examine.” What doesn’t he want to get out? source – The Atlantic

Iranian Ayatollah endorses evil
A senior Iranian cleric, who is known as President Mahmoud Ahmadinejad’s spiritual mentor, urged followers to continue suicide attacks against Israelis, including children.
Ayatollah Mohammad Taghi Mesbah, considered one of the Islamic Republic’s most radical clerics, issued a religious edict on his website whereby suicide attacks are not only legitimate but are a must for every Muslim, a special paper by the Middle East Media Research Institute shows.
The senior cleric was responding to a question from a follower regarding the difference between “martyr’s death” and “suicide.” The man, who wrote anonymously, noted that “some people say that martyrdom operations are considered suicide and that they are haram (forbidden) because they contradict Islam.” ”When protecting Islam, the Muslim people depend on martyrdom operations. It not only is allowed, but even is an obligation,” Mesbah wrote.
The follower presented another question regarding Islam’s position on harming Israelis, wondering whether Hamas and Jihad actions against Israeli civilians are forbidden. He also asked: “How about the Israeli children killed in such attacks?”
The Iranian Ayatollah did not see fit to forbid the killing of children, only noting that Israelis can be harmed unless they openly express their objection to their government’s position. He added that even in such cases, harming civilians is permissible if “they are used as human shield and fighting the aggressors depends on attacking those civilians.”
Beyond these insights, the cleric did not offer further instructions and failed to censure the killing of children.

Q: You stated that President Obama was “overruled” by military/intelligence officials regarding the decision to send in military specialists into the Osama Bin Laden compound. Was that accurate?A: I was told – in these exact terms, “we overruled him.” (Obama) I have since followed up and received further details on exactly what that meant, as well as the specifics of how Leon Panetta worked around the president’s “persistent hesitation to act.” There appears NOT to have been an outright overruling of any specific position by President Obama, simply because there was no specific position from the president to do so. President Obama was, in this case, as in all others, working as an absentee president.
I was correct in stating there had been a push to invade the compound for several weeks if not months, primarily led by Leon Panetta, Hillary Clinton, Robert Gates, David Petraeus, and Jim Clapper. The primary opposition to this plan originated from Valerie Jarrett, and it was her opposition that was enough to create uncertainty within President Obama. Obama would meet with various components of the pro-invasion faction, almost always with Jarrett present, and then often fail to indicate his position. This situation continued for some time, though the division between Jarrett/Obama and the rest intensified more recently, most notably from Hillary Clinton. She was livid over the president’s failure to act, and her office began a campaign of anonymous leaks to the media indicating such. As for Jarrett, her concern rested on two primary fronts. One, that the military action could fail and harm the president’s already weakened standing with both the American public and the world. Second, that the attack would be viewed as an act of aggression against Muslims, and further destabilize conditions in the Middle East.
Q: What changed the president’s position and enabled the attack against Osama Bin Laden to proceed?
A: Nothing changed with the president’s opinion – he continued to avoid having one. Every time military and intelligence officials appeared to make progress in forming a position, Jarrett would intervene and the stalling would begin again. Hillary started the ball really rolling as far as pressuring Obama began, but it was Panetta and Petraeus who ultimately pushed Obama to finally act – sort of. Panetta was receiving significant reports from both his direct CIA sources, as well as Petraeus-originating Intel. Petraeus was threatening to act on his own via a bombing attack. Panetta reported back to the president that a bombing of the compound would result in successful killing of Osama Bin Laden, and little risk to American lives. Initially, as he had done before, the president indicated a willingness to act. But once again, Jarrett intervened, convincing the president that innocent Pakistani lives could be lost in such a bombing attack, and Obama would be left attempting to explain Panetta’s failed policy. Again Obama hesitated – this time openly delaying further meetings to discuss the issue with Panetta. A brief meeting was held at this time with other officials, including Secretary Gates and members of the Joint Chiefs of Staff, but Gates, like Panetta, was unable to push the president to act. It was at this time that Gates indicated to certain Pentagon officials that he may resign earlier than originally indicated – he was that frustrated. “Senior western leaders called for NATO to adopt an assassination policy against Col Muammar Gaddafi to salvage the bombing campaign in Libya from a descent into stalemate. The calls came as Col Gaddafi was reported to have strengthened his grip on power by repatriating billions of dollars in overseas assets that should have been frozen by UN sanctions.
On Sunday, there was growing pressure on Coalition forces to directly target Col Gaddafi with military strikes.
Senator Lindsey Graham, a Republican member of the Senate Armed Services committee, said that the quickest way to end the emerging stalemate was to “cut the head of the snake off”. He said: “The people around Gaddafi need to wake up every day wondering, ‘Will this be my last?’
Senator John McCain, who visited Libya at the weekend, also said that the Libyan dictator should be targeted but argued that it was more important to increase American firepower over Libya. He said: “It’s pretty obvious to me that the US has got to play a greater role on the air power side.
